NON-COMPETE LITIGATION

PENNSYLVANIA NON-COMPETE AND RESTRICTIVE COVENANT LAW
The representation of companies and individuals in the legal evaluation, drafting, negotiation and, if necessary, litigation of Pennsylvania non-compete agreements and restrictive covenants is a growing area of my practice. Pennsylvania’s non-compete law has dramatically changed over the years. Enforcement of these clauses often turns on very technical elements scrutinized carefully by the courts, and these clauses are becoming ever more common.

RESTRICTIVE COVENANT LITIGATION BETWEEN COMPANIES AND EMPLOYEES

Whether you are an employer or employee, you need to be aware of the substantial body of case law that governs the enforceability of these provisions as well as the legal and equitable power a court can wield when a dispute arises. I have both enforced and defended aginst many of these clauses, enjoining employees who violated their contract, or preventing employers from wrongfully enforcing them.

BUSINESS LITIGATION

In addition to its Pennsylvania non-compete agreement and employment law practice, Joseph Caprara also frequently represents businesses and individuals in a wide variety of business litigation matters including contractual disputes between businesses. Because of his diverse legal background and experience, Joseph Caprara also serves as outside General Counsel to several companies and organizations.
